Terms of Service

By accessing or using the Languagecert Academy platform ("Platform", "Service"), you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Languagecert Academy.

If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Platform. Continued use after changes constitutes acceptance of the modified Terms.

To use Languagecert Academy, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Not be barred from receiving services under applicable laws
• Not have been previously banned from the Platform

If you are under 18, you represent that you have parental or guardian consent to use the Platform.

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You are solely responsible for safeguarding your password. We will never ask you for your password via email or phone.

You may not:

• Use another user's account without their express permission
• Share your account credentials with third parties
• Create multiple accounts to circumvent limitations or bans
• Transfer your account to another person without our written consent

Languagecert Academy provides an online platform for LanguageCert exam preparation, including:

• Mock Tests: Full-length practice exams replicating the LanguageCert test format
• Practice Questions: Module-based practice organized by skill (Listening, Reading, Writing, Speaking)
• AI Evaluation: Automated assessment of writing and speaking responses
• Progress Tracking: Analytics and performance dashboards
• Study Resources: Learning materials and study guides

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Pricing & Plans:

• Free plan with limited features is available at no cost
• Paid subscription plans (Basic, Premium, Annual) require payment of the stated price
• All prices are displayed in the applicable currency (USD or INR) and include applicable taxes unless stated otherwise

Payment Processing:

• Payments are processed through Instamojo (India) and PayPal (International)
• We do not store credit card or banking details on our servers
• You agree to the payment processor's terms of service in addition to these Terms

Auto-Renewal:

• Paid subscriptions automatically renew at the end of each billing period
• You will be charged the then-current rate unless you cancel before the renewal date
• You may cancel auto-renewal at any time through your account settings

All sales are final. No refunds are issued. See our Refund Policy for details.

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE.

By completing a purchase, you acknowledge that:

• No refunds will be issued for any reason, including dissatisfaction, non-use, or changes in personal circumstances
• No pro-rata refunds will be issued for cancellations made mid-billing cycle
• Cancellation stops future billing but does not entitle you to a refund for the current period
• The only exceptions are duplicate charges or complete platform failure, reviewed case-by-case

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Copy, reproduce, distribute, or resell any content from the Platform
• Use automated tools (bots, scrapers, crawlers) to access or interact with the Service
• Attempt to gain unauthorized access to any part of the Platform
• Circumvent or attempt to circumvent subscription limitations or usage restrictions
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate another person or misrepresent your affiliation
• Harvest or collect personal information of other users
• Share test content with individuals who have not purchased access

Violation of this policy may result in immediate account suspension or termination without notice or refund.

Platform Ownership: The Platform and all its original content, features, and functionality are owned by Languagecert Academy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Content Restrictions: You may not:

• Reproduce, distribute, or create derivative works of any Platform content
• Use our trademarks, logos, or branding without written permission
• Frame or mirror any part of the Platform on other websites or services
• Reverse engineer, decompile, or disassemble any software or technology

Your Content: You retain ownership of content you submit (test responses, speaking recordings). By submitting content, you grant us a limited, non-exclusive license to process, evaluate, and store your submissions for the purpose of providing the Service.

Our AI-powered evaluation provides automated feedback for practice and learning purposes only. Please understand:

• AI evaluations are estimates and should not be considered official LanguageCert scoring
• Actual exam results may differ significantly from AI practice scores
• AI may occasionally produce inaccurate, incomplete, or inappropriate evaluations
• AI-generated study plans and feedback are suggestions, not guarantees of improvement
• We are not responsible for decisions made based on AI evaluation results

We continuously improve our AI systems, but you should always consult official LanguageCert resources and qualified instructors for definitive assessment of your language proficiency.

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Platform, you consent to the data practices described in the Privacy Policy. We comply with applicable data protection laws, including GDPR and CCPA.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We expressly disclaim all warranties, whether express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that AI evaluations will match official exam results
• Warranties that the Platform will meet your specific requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Languagecert Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any loss of data, revenue, business, or profits
• We are not liable for damages resulting from third-party services, payment processors, or AI providers
• We are not liable for any damages arising from your reliance on AI evaluations or content accuracy

You agree to indemnify, defend, and hold harmless Languagecert Academy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your violation of any applicable law or regulation.

Termination by You: You may delete your account at any time through your account settings. Deleting your account does not entitle you to a refund.

Termination by Us: We may suspend or terminate your account immediately if you:

• Violate any provision of these Terms
• Engage in fraudulent, abusive, or illegal activity
• Fail to pay applicable fees when due
• Are subject to a legal request for termination

Upon termination, your right to access the Platform ceases immediately. We may retain your data as described in our Privacy Policy.

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or the Platform shall be resolved through:

• Negotiation: First, attempt to resolve disputes informally by contacting us
• Mediation: If informal resolution fails, submit to mediation before initiating formal proceedings
• Arbitration: Disputes not resolved through mediation shall be settled by binding arbitration

Any legal proceedings must be brought within one (1) year after the cause of action arises.

We reserve the right to modify these Terms at any time. Material changes will be communicated at least 30 days in advance via email or prominent notice on the Platform. Your continued use of the Platform after the effective date of modified Terms constitutes acceptance. If you do not agree to the modified Terms, you must stop using the Platform and delete your account.
